Photography Terms of Service
This agreement is entered into between the photographer and the listing agent for the purpose of providing photography services for the property listed.
Photography Services: The photographer agrees to provide photography services for the property listed above. The photos produced shall remain the property of the photographer, and the photographer retains all copyrights.
1. Usage Rights: The listing agent is granted a non-exclusive, worldwide, royalty-free license to use the photos for advertising and promotional purposes related to the sale or rental of the property. This includes, but is not limited to, online listings, print materials, social media, and other marketing channels.
2. Ownership and Copyright: The listing agent acknowledges that the photographer is the sole owner of the photos and retains all copyrights to the images. The listing agent shall not claim ownership of the photos or sell the images to any third party.
3. Modifications: The listing agent may crop, resize, or make minor edits to the photos for the purpose of fitting different advertising formats. However, any other modifications or alterations to the photos must be approved by the photographer.
4. Transferability: The rights granted to the listing agent under this agreement are non-transferable and may not be assigned to any third party without the express consent of the photographer.
5. Indemnification: The listing agent agrees to indemnify and hold harmless the photographer from any claims, damages, or liabilities arising out of the use of the photos by the listing agent.
By engaging the services of the photographer, the listing agent agrees to the terms and conditions outlined in this agreement.
Standard time for delivery of photos is 24-48 hours.
Every attempt will be made to deliver in the shortest time possible but no guarentees are made.
